The Facts

1. HOA Legal Fees and Ongoing Legal Liability

Since 2025, the HOA has incurred at least $35,352.94 in legal expenses related to ongoing conflicts, legal disputes, and governance issues ($8,316.22 in 2025 and $27,036.72 in 2026 as of May). [37]

The Association has also faced continued liability exposure requiring involvement of legal counsel and reports to the HOA insurance carrier in an effort to minimize risk to the community. Documented incidents include:

  • Cease and Desist letters sent to Board Members [7.4][19]

  • Cease and Desist letter to Board members’ Personal Estates and Beacon Property Management Company [19]

  • Legal threats sent to a Board Member’s employer demanding termination [7.5]

  • Cease and Desist letters sent to homeowners [17]

  • Legal threats directed toward HOA vendor [7.13]

  • Discrimination allegations directed toward the Former Property Manager and Current Board Member [6][7.2][7.5]

The HOA’s 2026 legal fee budget was only $5,400. Current legal-related costs have already exceeded that amount by approximately $21,636 in only half the year. If these expenses continue, homeowners could ultimately face increased yearly dues or a special assessment to cover the overage.

These ongoing conflicts have not only created a substantial financial burden on homeowners , but also expose the Association to continued legal liability and reputational risk

2. Retaliatory, Divisive, and Unprofessional Conduct

Shortly after the 2025 election, a pattern of retaliatory, divisive, and unprofessional conduct became evident during Board meetings and spread to those who expressed disagreement or opposition.

 

In addition to the previously referenced legal threats and allegations, other examples include:

  • Referring to a fellow Board Member as a “snake” following the Board’s internal presidency vote [3]

  • Creating Board confusion by demanding No Communications or references to Board affiliation [7.3] followed by Cease and Desist demands [7.4][7.5] but then demands the Board forward ALL communications and requires inclusion [7.6] all within 7 days.

  • Sending communications containing derogatory references toward Board Members [7.6]

  • Belittling and/or dismissing Board members and/or homeowners causing community division [5][11][15][17][22][25][26][27][30][33][34]

  • Excluding certain homeowners from community communications after they voiced concerns or expressed disagreement [24]

 

These repeated incidents contribute to distrust, conflict, and division throughout the community while negatively impacting homeowner engagement and collaboration.

3. Misuse of HOA Communications and Unilateral Conduct

Documented incidents reflect ongoing unilateral and exclusionary conduct involving HOA communications, committee participation, and actions taken outside normal collaborative Board processes.

 

These actions cause confusion regarding official HOA representation, reduce transparency, and disrupt the efficiency of HOA governance including:

  • Creating and maintaining control over a privately created HOA Gmail account intended for Board-related communications for personal use [14]

  • Encouraging homeowners not to attend the November 2025 Special Meeting [5]

  • Selectively Including or Excluding homeowners from community-wide emails against their written requests [25][32]

  • Sending unilateral HOA-related petitions, meetings, announcements, and event communications without Board approval or coordination [9][21][22][25][26][30][31][34][35][37][39]

  • Restricting participation in Maintenance Committee business and excludes former committee member(s) from continued involvement [20]

  • Requesting information but controlling the sharing of same information relevant to ongoing community concerns [20][21][22][25][26][31][33][34][35][36][39]

  • Publicly undermining official Board communications and contributing to confusion regarding Board authority and representation [5] [14][33]

  • Sharing communications containing references to a Board Member’s familial criminal history despite no affiliation to the HOA [30]

  • Redirecting HOA-related communications through unofficial or undefined committee structures without formal Board authorization [35]

 

These hinder effective HOA operations, reduce collaboration among volunteers and Board Members, and contribute to growing homeowner frustration and distrust.

4. Negative Impacts and Obstruction of Effective HOA Operations

With all of the above mentioned challenges, homeowners have increasingly expressed reluctance to participate in HOA activities and leadership efforts causing a decline in community participation efforts.

 

Some potential impacts include:

  • Candidate participation in HOA elections declining from 8 candidates during the September 2025 election to only 3 candidates during the January 2026 replacement election [1][18]

  • Reduced progress within the Maintenance Committee resulting in Finance Committee members taking on additional responsibilities, including obtaining vendor quotes for common area projects such as pressure washing, roof repair, repainting, graffiti removal, and tree trimming services [20]

  • Community volunteer participation appearing impacted, with the Social Events Committee receiving only 1 volunteer while independent homeowner-led BBQ received 8 volunteers [35]

  • Delays and concerns surrounding completion of community initiatives, including the graduation banner project being publicly questioned weeks before graduation [36]

 

It appears that the ongoing concerns with the Board are impacting the overall functionality of the Association as a whole. These ongoing operational issues contributed to declining homeowner trust, reduced community involvement, volunteer fatigue, and diminished confidence in the HOA’s ability to function effectively and collaboratively.

5. PHR United

Our goal is not division, but accountability and positive change so the community can move forward with professionalism, transparency, and renewed trust in HOA leadership while also eliminating unnecessary legal expenses.

We believe our community is strongest when neighbors collaborate respectfully, volunteers feel supported, and Board leadership remains focused on the best interests of the Association as a whole.
